Accessibility & Responsibility Statement
This Accessibility & Responsibility Statement ("Statement") applies to JulieKinne.com and is operated by Legacy Performance Marketing LLC and its related brands, products, and services, including without limitation LimeFunnels, LimeFunnels Pro, LimeFunnels.com, LimeFunnelsPro.com, LimeLabs Marketing LLC, and any current or future affiliated, parent, or subsidiary entities (collectively, "Company", "we", "us", or "our").
This Statement is incorporated by reference into, and forms part of, our Terms of Use / Terms of Service and any applicable subscription, license, or services agreement between you and Company (collectively, the "Agreement").
1. Role of Company as a Platform Provider
1.1 Company operates software and related services that allow customers to build, host, and manage websites, funnels, landing pages, forms, courses, and other digital properties (collectively, "Customer Properties").
1.2 Company is a **platform provider** and infrastructure provider only. Customers, and any designers, developers, or agencies engaged by them, control the content, structure, configuration, user interface, and third‑party integrations used in their Customer Properties. Company does not review, approve, or publish Customer Properties and is not the author or owner of the content appearing on Customer Properties.
2. No Accessibility or Legal Advice
2.1 Company does not provide legal advice, accessibility consulting, or professional guidance regarding compliance with the Americans with Disabilities Act ("ADA"), Section 508, the Web Content Accessibility Guidelines ("WCAG") 2.1 or 2.2 Level A or AA, any regulations or guidance issued by the U.S. Department of Justice ("DOJ"), or any similar federal, state, local, or international law, regulation, or standard (collectively, "Accessibility Laws and Standards").
2.2 Any mentions of WCAG 2.1, WCAG 2.2, ADA, DOJ rules, or similar frameworks in our marketing, documentation, or within the platform are for general informational purposes only and do not constitute a representation, warranty, guarantee, or legal opinion that any particular Customer Property is or will be compliant with Accessibility Laws and Standards.
3. Platform Features and No Warranty of Compliance
3.1 The Company platform may include features, settings, and technical capabilities that can be used by customers to support efforts toward alignment with WCAG 2.1 and WCAG 2.2 Level A/AA and related guidance. These features are tools only and are not, by themselves, sufficient to ensure legal compliance or full conformance with any Accessibility Laws and Standards.
3.2 Company does not represent, warrant, or guarantee that:
(a) the platform, any built‑in features, or any default or sample designs are fully compliant with WCAG 2.1, WCAG 2.2, ADA, DOJ rules, Section 508, or any other Accessibility Laws and Standards;
(b) any Customer Property built, hosted, or managed on or through the platform will achieve or maintain compliance with Accessibility Laws and Standards; or
(c) any given configuration, template, integration, or customization will remain compliant as standards, technologies, and legal interpretations evolve.
3.3 The platform, including any accessibility‑related features, is provided "AS IS" and "AS AVAILABLE," without any warranties of any kind, express or implied, including any warranty of compliance with Accessibility Laws and Standards, in addition to the warranty disclaimers contained in the Agreement.
4. Customer Responsibility for Accessibility Compliance
4.1 The customer (including any sub‑account holder, site owner, or account owner) is solely and entirely responsible for:
(a) the selection, design, structure, and user interface of their Customer Properties;
(b) all content, media, text, images, video, audio, documents, forms, and other materials published or made available on Customer Properties;
(c) all HTML, CSS, JavaScript, or other code added, modified, or used in Customer Properties; and
(d) all third‑party services, widgets, scripts, plugins, embeds, and other integrations implemented in or in connection with Customer Properties.
4.2 Without limiting the foregoing, customers are solely responsible for:
(a) understanding and monitoring the Accessibility Laws and Standards that may apply to their business, industry, or users;
(b) determining which WCAG level(s) (including WCAG 2.1 and WCAG 2.2 Level A/AA) or other standards are applicable to their Customer Properties;
(c) implementing and maintaining design and content choices that support accessibility; and
(d) obtaining their own independent legal and accessibility advice and conducting their own audits, testing, and remediation as needed.
4.3 Company is not responsible for, and has no obligation to monitor or correct, any accessibility issues arising from:
(a) the customer's design or UX choices;
(b) the customer's content, media, or documents;
(c) the customer's code customizations; or
(d) the customer's use of third‑party tools, scripts, or integrations.
5. Third‑Party Tools, Templates, and Integrations
5.1 Customer Properties may include third‑party services, templates, code, or widgets (including but not limited to chat widgets, analytics, marketing scripts, embedded video players, or other third‑party components). Company does not control these third‑party offerings and does not make any representation or warranty regarding their accessibility or compliance with Accessibility Laws and Standards.
5.2 The customer is solely responsible for evaluating the accessibility and legal compliance of all third‑party tools and integrations used on their Customer Properties and for addressing any accessibility or legal issues associated with them directly with the relevant third party.
6. Best Efforts for Platform‑Level Accessibility
6.1 Company aims, on a reasonable and commercially practicable basis, to develop and maintain the core platform in a manner that is generally consistent with modern accessibility principles and the evolving guidance reflected in WCAG 2.1 and WCAG 2.2 Level A/AA and relevant DOJ and similar guidance, recognizing that perfect, error‑free, or universal conformance at all times is not realistically achievable.
6.2 From time to time, Company may make updates to the platform to improve accessibility at the platform level. However, customers understand and agree that:
(a) accessibility issues may still exist or arise;
(b) updates may not address all issues affecting any particular Customer Property; and
(c) Company has no duty to customize, audit, or remediate individual Customer Properties.
6.3 If Company becomes aware of a material platform‑level accessibility issue within its reasonable control, Company may, but is not obligated to, address such issue in the ordinary course of development, without any obligation to provide a specific remedy, timeline, or result for any particular customer or user.
7. No Assumption of Liability for Customer Properties
7.1 To the maximum extent permitted by applicable law, Company disclaims any and all liability arising out of or related to the accessibility or alleged inaccessibility of any Customer Property, including but not limited to any claim that a Customer Property does not comply with WCAG 2.1, WCAG 2.2, ADA, DOJ rules, Section 508, or any other Accessibility Laws and Standards.
7.2 Customers understand and agree that any legal duties or obligations under Accessibility Laws and Standards with respect to Customer Properties, including public‑facing sites and digital services, rest solely with the customer and not with Company or any of its owners, officers, directors, employees, contractors, or affiliates.
8. Indemnification and Hold Harmless
8.1 In addition to any indemnification obligations set forth in the Agreement, the customer agrees to indemnify, defend, and hold harmless Legacy Performance Marketing LLC, its owners, officers, directors, members, managers, employees, contractors, agents, successors, and assigns, as well as any related or future entities, brands, or trade names (including without limitation LimeLabs Marketing LLC, LimeFunnels, LimeFunnels Pro, and any other affiliated or related company), from and against any and all claims, demands, actions, investigations, complaints, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to:
(a) the accessibility, usability, or alleged inaccessibility of any Customer Property;
(b) any alleged violation of WCAG 2.1, WCAG 2.2, ADA, DOJ rules, Section 508, or any other Accessibility Laws and Standards by a Customer Property;
(c) the customer's content, design, code, or third‑party integrations used on or in connection with a Customer Property; or
(d) any demand, investigation, lawsuit, administrative proceeding, settlement, or claim brought by any user, consumer, regulator, or third party relating to accessibility of a Customer Property.
8.2 This indemnity is intended to be broad and to cover, without limitation, any attempt to name Company or any of its related entities or individuals as a defendant, respondent, or party in any action or proceeding asserting accessibility‑related claims against a Customer Property.
9. Governing Law and Venue
9.1 This Statement and any dispute, claim, or controversy arising out of or relating to accessibility, Accessibility Laws and Standards, or the subject matter of this Statement shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice‑of‑law or conflict‑of‑law rules.
9.2 Subject to any arbitration or dispute‑resolution provisions in the Agreement, the exclusive venue for any permitted judicial action arising out of or relating to this Statement or the accessibility of the platform shall be the state or federal courts located in Orange County, Florida, and the parties consent to the personal jurisdiction of such courts.
10. Updates to This Statement
10.1 Accessibility standards, technologies, and legal requirements evolve over time. Company may update or modify this Statement at any time, in its sole discretion, by posting a revised version on one or more of its websites or within the platform.
10.2 Any updated Statement will be effective as of the date it is posted, and continued use of the platform after such posting constitutes acceptance of the updated Statement.
